Terms of Service

These Terms of Service ("Terms") govern your use of rockstardev.org and any consulting services provided by RockstarDev Inc, an Illinois S Corp ("we", "us", "our"). By using the site or engaging our services you agree to these Terms.

1. Services we provide

We provide custom IT solutions, software development, infrastructure and DevOps consulting, systems integration, security and audit reviews, technical due diligence, embedded engineering, and access to software tools, platforms, and ongoing service offerings. Specific scope, deliverables, pricing, and billing structure (one-time, periodic, or recurring) for any engagement are defined in a separate written agreement (a Statement of Work, service agreement, or similar) executed between RockstarDev Inc and the client.

2. The website itself

You may use rockstardev.org for any lawful purpose. You may not:

• Use the site to send unsolicited commercial messages or test attacks.
• Attempt to gain unauthorized access to any portion of the site or related infrastructure.
• Copy, modify, or redistribute the content for commercial purposes without our written consent.

3. Invoices and payments

3.1 Payment methods

We accept payment via Stripe-processed credit card through this site, ACH transfer, wire transfer, or other arrangements agreed in writing.

3.2 Stripe processing

When you pay an invoice on this site, your card data is transmitted directly to Stripe. We do not handle, store, or have access to your card details. By using Stripe checkout you agree to Stripe's Terms of Service and Privacy Policy.

3.3 Invoice and fee terms

Unless otherwise specified in your engagement agreement, invoices are due upon receipt. Recurring or periodic service fees, when applicable to your engagement, are billed in advance for the upcoming service period. Past-due amounts may accrue interest at the lower of 1.5% per month or the maximum rate permitted by Illinois law.

3.4 Currency

All amounts are in US Dollars unless otherwise stated.

4. Intellectual property

Ownership of work product produced under a paid engagement is governed by the Statement of Work for that engagement. Site content (rockstardev.org), logos, and brand marks are owned by RockstarDev Inc.

5. Confidentiality

We treat client information disclosed during engagements as confidential and use commercially reasonable measures to protect it. Specific confidentiality terms (including non-disclosure scope and duration) are governed by your engagement agreement.

6. Warranties and disclaimers

WE PROVIDE THE SITE AND SERVICES "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE-OF-PERFORMANCE. Specific service warranties, if any, are governed by the relevant Statement of Work.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ROCKSTARDEV INC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SITE OR SERVICES.

FOR ANY CONSULTING ENGAGEMENT, OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE FEES PAID BY YOU FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless RockstarDev Inc, its officers, directors, employees, and agents, from any claims, damages, or expenses arising from your breach of these Terms or your unlawful use of the site or services.

9. Termination

We may suspend or terminate your access to the site at any time for any reason. For paid consulting engagements, termination is governed by the relevant Statement of Work; we will deliver work completed up to termination and invoice for it pro-rata.

10. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Cook County, Illinois.

11. Changes

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes for active engagements will be communicated directly.
